Rental Terms & Conditions

These Dumpster Rental Terms & Conditions apply to dumpster rental services provided by NOCA Holdings LLC d/b/a NOCA Dumpsters ("NOCA Dumpsters," "we," "our," or "us").
By placing an order, submitting a rental agreement, making a payment, authorizing a card on file, accepting delivery of a dumpster, or using our services, the customer acknowledges, understands, and agrees to the following terms.
1. Dumpster Delivery and Placement
Customer requests that NOCA Dumpsters deliver a dumpster to the delivery address provided.
NOCA Dumpsters will make reasonable efforts to place the dumpster in the requested location, provided the driver determines the location is safe, accessible, and legal. Final placement is at the discretion of NOCA Dumpsters.
Customer is responsible for ensuring that the delivery area is clear, accessible, and suitable for dumpster placement. This includes, but is not limited to, removing vehicles, trailers, equipment, debris, low-hanging branches, snow, ice, locked gates, or other obstructions.
NOCA Dumpsters may refuse or delay delivery if the requested placement area is unsafe, inaccessible, too soft, too steep, blocked, restricted, or otherwise unsuitable.
Customer is responsible for all permits, permissions, approvals, and requirements related to dumpster placement, including placement on public roads, sidewalks, rights-of-way, shared driveways, rental properties, commercial properties, or properties not owned by the customer.
Customer is responsible for any fines, penalties, towing charges, permit violations, or other costs resulting from failure to obtain proper permission or permits.
2. Property Damage
Customer understands that dumpster trucks and dumpsters are heavy and may cause damage to driveways, asphalt, concrete, pavers, lawns, curbs, sidewalks, underground utilities, septic systems, landscaping, irrigation systems, or other property.
NOCA Dumpsters will take normal precautions during delivery and pickup, but NOCA Dumpsters does not guarantee that damage will not occur.
Customer assumes all risk and responsibility for any damage to the driveway, sidewalk, yard, lawn, landscaping, underground utilities, septic system, pavement, concrete, asphalt, pavers, curbing, or any other portion of the property during delivery, placement, rental period, and pickup.
Boards, wood, or other protective materials may reduce the risk of damage but do not guarantee prevention of cracks, scratches, sinking, rutting, stains, dents, or other damage.
NOCA Dumpsters assumes no liability for property damage resulting from delivery, placement, use, or pickup of the dumpster.
3. Customer Responsibility for Contents
Customer is solely responsible for all materials placed in the dumpster.
Customer remains responsible for the contents of the dumpster until the landfill, transfer station, recycling facility, or disposal site accepts the material.
Customer is responsible for prohibited items, overweight loads, contamination, rejected loads, additional disposal charges, cleanup costs, and any other costs caused by the materials placed in the dumpster.
Customer is responsible for materials placed in the dumpster by the customer, contractors, subcontractors, employees, tenants, neighbors, guests, unknown third parties, or any other person.
4. Rental Period
Each dumpster rental includes the rental period selected by the customer.
Unless otherwise stated, rental periods are based on the delivery date and scheduled pickup date selected or assigned at the time of order.
If the customer needs the dumpster picked up early, swapped out, or extended beyond the scheduled pickup date, customer must contact NOCA Dumpsters as soon as possible.
Rental extensions are not guaranteed and depend on dumpster availability and scheduling.
Additional rental days may result in extra daily charges.
If NOCA Dumpsters is unable to pick up the dumpster on the scheduled pickup date due to scheduling, weather, equipment issues, or other circumstances not caused by the customer, no additional rental day charge will be applied for that delay.
5. Pickup Requirements
Customer is responsible for making sure the dumpster is ready and accessible for pickup on the scheduled pickup date.
NOCA Dumpsters may begin pickups as early as 7:00 A.M.
Customer must not block the dumpster on the day of pickup.
The dumpster must be accessible and free from vehicles, trailers, equipment, locked gates, low-hanging wires, low-hanging branches, snow, ice, debris, or any other obstruction that prevents safe pickup.
If NOCA Dumpsters arrives for pickup and the dumpster is blocked, inaccessible, overloaded, unsafe to haul, or otherwise unable to be picked up, a return trip fee may be charged.
Additional rental day fees may also apply until the dumpster can be safely picked up.
6. Level Loads Only
Dumpsters must be loaded level with or below the top edge of the dumpster.
Items may not stick above the sides of the dumpster.
Overloaded dumpsters, or dumpsters loaded higher than the maximum load level, may not be hauled.
It is unsafe and unlawful to haul dumpsters with material loaded above the sides of the container.
If the dumpster is overloaded, customer must remove the excess material before pickup.
A return trip fee and additional daily rental fees may apply if NOCA Dumpsters cannot haul the dumpster because it is overloaded.
7. Included Disposal Weight
Dumpster rentals include a specific amount of disposal weight based on dumpster size. The included disposal weight is as follows:
- 10 Yard Dumpster: Includes 1/2 ton, or 1,000 pounds.
- 15 Yard Dumpster: Includes 1 ton, or 2,000 pounds.
- 20 Yard Dumpster: Includes 2 tons, or 4,000 pounds.
- 30 Yard Dumpster: Includes 3 tons, or 6,000 pounds.
Any weight over the included disposal allowance may result in additional overweight charges.
The maximum allowed weight in any NOCA Dumpsters container is 3 tons, or 6,000 pounds, unless specifically approved in writing by NOCA Dumpsters.
8. Overweight Loads
Customer is responsible for all overweight charges.
Dumpsters that exceed the included disposal weight may be billed at the current overweight rate.
Dumpsters that are too heavy to safely or legally haul may not be picked up until excess material is removed.
If a dumpster cannot be picked up because it is overweight, customer is responsible for removing material until the dumpster can be safely hauled.
A return trip fee and additional daily rental fees may apply if NOCA Dumpsters cannot pick up the dumpster due to overweight conditions.
Dense materials such as shingles, concrete, brick, plaster, dirt, rock, sand, tile, masonry, asphalt, and similar materials are very heavy and may quickly exceed the included weight allowance.
Small amounts of dense materials may be permitted only if they do not cause the dumpster to exceed the allowed weight limits.
NOCA Dumpsters reserves the right to refuse or limit dense materials.
9. No Machine Loading
Machine loading is not permitted unless specifically approved in writing by NOCA Dumpsters.
This includes, but is not limited to, loading with Bobcats, skid steers, loaders, backhoes, forklifts, excavators, tractors, or other machinery.
Customer is responsible for any damage caused by machine loading.
10. Prohibited Materials
The following items are not allowed in NOCA Dumpsters containers:
- Hazardous waste
- Biomedical waste
- Radioactive waste
- PCB or regulated chemical waste
- Liquid waste
- Wet paint
- Automobile fluids
- Oil
- Gasoline
- Diesel fuel
- Transmission fluid
- Hydraulic fluid
- Antifreeze
- Solvents
- Pesticides
- Herbicides
- Industrial waste
- Medical waste
- Asbestos
- Propane tanks
- Aerosol cans
- Batteries
- Lead acid batteries
- Tires
- Food waste
- Animals
- Freon-containing items
- Refrigerators
- Freezers
- Air conditioners
- Dehumidifiers
- Railroad ties
- Fluorescent tubes
- Contaminated soil
- Paint cans containing wet paint
- Hot ash
- Coal
- Burning, smoking, or recently burned materials
- Any flammable, toxic, hazardous, regulated, or prohibited material
This list is not exhaustive. NOCA Dumpsters reserves the right to reject or charge additional fees for any material that is prohibited, unsafe, regulated, contaminated, unusually difficult to dispose of, or not accepted by the landfill, transfer station, recycling facility, or disposal site.
11. Liquids and Paint
Liquids are prohibited from the dumpster.
Wet paint is not allowed.
Paint may only be placed in the dumpster if it is completely dry and hardened.
If wet paint or liquid waste is discovered, customer may be charged additional disposal, cleanup, or handling fees.
12. Freon Items
Items that contain, or have contained, Freon are not allowed in the dumpster.
This includes refrigerators, freezers, air conditioners, dehumidifiers, and similar items.
NOCA Dumpsters may be able to haul these items separately through junk removal service, if available.
Customer must contact NOCA Dumpsters in advance for pricing and arrangements.
13. Appliances
Appliances may be allowed only if they do not contain, and have not contained, Freon.
NOCA Dumpsters reserves the right to reject appliances or charge additional fees depending on disposal requirements.
14. Tires
Tires are not allowed in the dumpster.
If tires are discovered in the dumpster, additional disposal fees may apply for each tire.
NOCA Dumpsters may be able to haul tires separately through junk removal service, if available.
Customer must contact NOCA Dumpsters in advance for pricing and arrangements.
15. Batteries
Lead acid batteries and similar batteries are not allowed in the dumpster.
These items must be disposed of properly through an approved recycling or disposal location.
16. Hot Ash, Coal, and Fire-Damaged Materials
Hot ash, coal, embers, or any material that is hot, smoking, smoldering, recently burned, or not fully extinguished is strictly prohibited.
Customer must contact NOCA Dumpsters for instructions before disposing of ash, coal, or fire-damaged material.
Customer is responsible for any fire, damage, cleanup, or liability caused by improper disposal of hot or flammable materials.
17. Mattresses and Box Springs
Mattresses and box springs may be permitted but may result in additional disposal fees.
Customer is responsible for any mattress or box spring disposal charges.
18. Shingles, Concrete, Brick, Plaster, Dirt, Rock, and Other Dense Materials
Shingles, concrete, brick, plaster, dirt, rock, sand, tile, masonry, asphalt, and other dense materials are extremely heavy.
These materials may quickly exceed the included weight allowance and may create unsafe hauling conditions.
Customer must notify NOCA Dumpsters in advance if disposing of dense materials.
NOCA Dumpsters reserves the right to refuse, limit, or apply special pricing for dense materials.
19. Rejected or Contaminated Loads
If a load is rejected, delayed, reclassified, or charged additional fees by a landfill, transfer station, recycling facility, or disposal site due to prohibited materials, contaminated materials, overweight conditions, misrepresented contents, or any other issue caused by the contents of the dumpster, customer is responsible for all resulting charges.
These charges may include, but are not limited to, additional hauling, labor, disposal, cleanup, sorting, storage, return trip, administrative, and facility fees.
20. Blocked or Failed Pickup
Customer must make sure the dumpster is not blocked on the scheduled pickup date.
If the dumpster is blocked, inaccessible, overloaded, too heavy, unsafe, or unable to be picked up for any reason caused by the customer, site conditions, or dumpster contents, customer may be charged a return trip fee.
Additional rental day fees may apply until the dumpster can be safely picked up.
NOCA Dumpsters may make another pickup attempt on the next available business day or as scheduling allows.
21. Weather, Snow, Ice, and Ground Conditions
Customer is responsible for ensuring that the delivery and pickup area is safe and accessible.
During winter or poor weather conditions, customer is responsible for ensuring that the area is plowed, shoveled, sanded, salted, and free of snow or ice that would prevent safe delivery or pickup.
NOCA Dumpsters may delay, refuse, or reschedule delivery or pickup due to unsafe road conditions, driveway conditions, weather, snow, ice, soft ground, mud, flooding, or any other condition that makes service unsafe or impractical.
Additional trip fees may apply if service cannot be completed due to site conditions.
22. Damage to Dumpster
Customer is responsible for any damage to the dumpster beyond normal wear and tear.
Damage includes, but is not limited to, burn marks, fire damage, machinery damage, vehicle damage, paint, graffiti, holes, large dents, bent doors, damaged hinges, peeled decals, overloaded damage, or any other misuse of the dumpster.
Customer is responsible for repair or replacement costs resulting from damage during the rental period.
23. Safety
Customer agrees to use the dumpster safely and responsibly.
Children are not allowed in, on, around, or near the dumpster.
No person should climb into, climb on, play in, stand on, or enter the dumpster.
Customer is responsible for keeping the dumpster area safe.
NOCA Dumpsters assumes no liability for injuries sustained while in, on, around, or loading the dumpster.
24. Indemnification and Limitation of Liability
Customer agrees to indemnify, defend, and hold harmless NOCA Holdings LLC d/b/a NOCA Dumpsters, including its owners, members, managers, employees, contractors, drivers, agents, affiliates, successors, and assigns, from and against any and all claims, damages, fines, penalties, injuries, losses, liabilities, costs, expenses, attorney fees, and other charges arising out of or related to the rental, delivery, placement, use, loading, contents, possession, pickup, hauling, disposal, or attempted disposal of the dumpster.
This includes, but is not limited to, claims or costs related to property damage, personal injury, prohibited materials, overweight loads, contaminated loads, rejected loads, permit violations, unsafe site conditions, customer instructions, blocked access, improper loading, third-party dumping, or misuse of the dumpster.
Customer's responsibility under this section applies whether the issue was caused by the customer, contractors, subcontractors, employees, tenants, guests, neighbors, unknown third parties, or any other person placing materials in or around the dumpster during the rental period.
In no event shall NOCA Dumpsters' total liability to the customer exceed the total amount paid by the customer for the rental in question.
25. Payment Authorization and Card on File
Customer authorizes NOCA Holdings LLC d/b/a NOCA Dumpsters to charge the payment method provided for rental charges and any additional amounts owed under these Terms.
Additional charges may include, but are not limited to, overweight charges, disposal overages, extra rental days, return trip fees, blocked pickup fees, prohibited item disposal fees, wet paint or liquid disposal fees, tire fees, mattress or box spring fees, Freon item fees, appliance disposal fees, rejected or contaminated load fees, sorting or cleanup fees, dumpster damage, permit violation fees, administrative fees, and other charges caused by the customer, site conditions, dumpster contents, prohibited materials, or misuse of the dumpster.
If a card is kept on file, customer authorizes NOCA Dumpsters to charge that card for amounts owed under the rental agreement.
26. Cancellations and Refunds
Cancellations made more than 24 hours before the scheduled delivery date will receive a full refund.
Cancellations made less than 24 hours before the scheduled delivery date may be subject to a cancellation fee to cover scheduling and dispatch costs.
If a driver has been dispatched or the dumpster has already been loaded for delivery, the full delivery fee may be charged.
Once a dumpster has been delivered, the rental is non-refundable.

27. Governing Law and Severability
These Terms are governed by the laws of the State of Maine, without regard to its conflict of laws provisions.
Any dispute arising out of or relating to these Terms or the rental services shall be resolved in the state or federal courts located in Cumberland County, Maine, and customer consents to the jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
28. Acknowledgment and Acceptance
By placing an order, signing an agreement, submitting payment information, accepting delivery, or using NOCA Dumpsters services, customer confirms that they have read, understand, and agree to these Dumpster Rental Terms & Conditions.
Customer understands that acceptance of these terms is required before rental service can be provided.
Customer agrees to be responsible for the dumpster, the contents placed inside the dumpster, site access, proper loading, prohibited materials, overweight charges, additional fees, property damage risk, and all obligations described in these terms.
Customer understands that NOCA Dumpsters may refuse, delay, or cancel service if these terms are not followed.
